Should the law consider the intent of criminals when crimes are committed?

Question by Savage serenity: Should the law consider the intent of criminals when crimes are committed?
I have heard a few arguments from people who believe that hate crimes should not exist. Let me clarify that ambiguous statement: these people who believe that hate crimes shouldn’t exist aren’t wishing or hoping for a perfect world, wherein people aren’t targets of unfair prejudice or animosity. They believe hate crimes should not exist in that they should be taken out of the legal system altogether, and that it may be dangerous to prosecute people for his or her state of mind when a crime is committed. They argue that crime is crime, and that people shouldn’t be jailed for their thoughts. I entirely agree that people should be able to think whatever they wish.

However, what about intent? The point of bringing up intent doesn’t have anything to do with what someone may think, it has to do with why they do something. Is that not important? Isn’t the reason for someone’s actions important? Obviously, the action itself, what actually happens, is more important than intentions- yes?

If you are opposed to ‘hate crime’ laws, would you also assert that killing is killing, when it comes to human beings? Should a man who accidentally shoots his best friend on a hunting trip receive the same sentence as a serial killer who rapes someone, tortures that person, then sadistically kills them?

The point I am trying to make is that intent should be taken into account when it comes to certain crimes. Perhaps not all crimes, but certain ones. Which ones? Anything felonious, such as rape, murder, and other capital crimes.

I didn’t break the laws, I don’t have intention to break the laws. I take care of everythings. I don’t know why I am “really suck” by the Ambulence around the Elementary School in my area where there is no even a police car. Is a real Criminal affaid of intensefied Medical cars???
Every time I go to the Bus station, there are always at lease one medical car coming while police is missing 99% of time or there is only the undercover policemen.
Do a criminal scare the medical cars? But it is really harming my mental health.

The Power of Intention – Getting to Tell my Story!

I had planned my trip so that I would be in New York on that particular day. I’d been following them with emails and podcasts and telling everyone and their friends all about it. And now I was going to get to be there. I kept saying that with the right intention, my name would be picked. I had been channeling the right intention for weeks. I had told everyone, family, friends and clients to send messages of this intention so that I would get to tell my story.

Yes, I’m talking about the Moth Storytelling Club in New York.

I was so excited to finally be there and just knew that it was my time, I would get to tell my story in the big apple! We decided to go by the club to make sure we had the right address, nice and early. There was already a line at the door that reached the end of the block. The guy at the front looked like he’d been there before.

He had a sandwich and a drink and was relaxing as he waited. He said that there was no chance of just showing up and getting in, we’d have to get into the line. He was right and though it was an hour before the doors opened the line was thickening and lengthening fast! We joined it. When we finally got inside almost all the tables were already taken and the bar was low ceilinged and cramped. We found a table at the back and wondered about the lack of exits as the place filled up quickly.

The atmosphere was loud, young and excited. The hat on the stage was quickly filling with names. The topic this month was ‘Near Death’. The requirement was real life stories told without notes. 40 people put their names in the hat and 10 were to be pulled out during the evening. My stomach was churning, my heart beating wildly as the first few names were called and the stories began.

Each time the stories were judged by 3 teams of judges who were even more excited than the rest of the heaving, vibrating and incredibly responsive crowd.

The stories were varied, some spectacular, others less so. The company was wonderful, not just my companion and friends that I had chosen to be with that evening. Something magical seemed to be happening in that cramped uncomfortable place. The stories were binding us together. The stories were creating a universal experience, the stories were making a community.

By the time they reached the 9th person I was beginning to doubt the power of intention and all those messages that had been sent to the universe. I was enjoying the storytelling all the same. After the stories ended, those people who had not been chosen were invited to come up on to the stage, one at a time, and tell the first line of their story. It seemed a cheap consolation but transpired to be more interesting than several of the stories told during the evening. I stood in line and said my line. We were all applauded and we drained the last drops of our drinks,left the club and hit the warm air of an autumn evening in New York.

As we walked down the block with our heads full of the stories we had just heard, the couple walking behind me were discussing the story that had won. “The one about the horses was SO much better”, they said, and I turned around and agreed. The man said to me, “I really wanted to hear your story”. “I really wanted to tell it”, I told him. “So do”, he said. “What right here on the sidewalk”, I asked and he smiled. So I started to tell my story! And when I finished telling it he thanked me and said that the outcome of the competition might have been different had I had the chance to tell my story. They were kind words that warmed me as I walked away and had a sudden amazing revelation. The power of intention works, the universe had heard all those messages. I got to tell my story in New York!

My sis in law, asked me to pick up her daughter after church easter morning and did not make it very clear, but I had all intentions of doing so. That morning we had a easter egg hunt at the church grounds and my 4 children under 4 were gathering eggs and then as my mind was in a rush to hurry and get the meal preps done at my in-laws. I forgot to look for my niece. I got a call to remind me about her from my sis, so I hurried back and not seeing her was very sure another family member had her. Well it turned out I was right, but it made my sis-in-law very mad at me. She came to the party saw her daughter was not there and then stormed out the house, leaving all our guests and us in shock. As it was no big deal where her daughter was. She was safe with another family member and now my sis has cut me out of her life. What would you do to try and make this right. I have apologised over and over, to no worth.

Just give it some time. Doesn’t sound too harmful to me either since you were at church and a family member took her. Get the person who did pick her up to talk to your sister-in-law, or your brother.

A crime a breach of a statutory duty, it is also known as offence. When a person does a crime his liability is determined the elements of crime. Which are guilty intentions and wrong act. Thus when these too constitute together and crime is performed.

Definitions of Crime:

Crime is a word of which the interpretation has varied with the philosophic bias of the writer; it has been described as the violation of rights, when considered in reference to the evil tendency of such violation, as regards the community at large, but this definition is too wide; and would include any evil actor movement whether or not it is punishable by law.

There is some important definition as follow……

 

According to Austin; “A wrong which is pursued at the discretion of the injured party or his representatives in a civil injury, a wrong which is pursued by sovereign or his subordinates is a crime”.
According to Blackstone; “An act committed or omitted in violation of public law forbidding or commanding it” his other definition is “Crime is a violation of public rights and duties due to the whole community considered as community”.
According to Stephen; “A crime is a violation of a right considered in reference to the evil tendency of such violation as regards the community at large”.

 

 Crime is an act of omission or commission, contrary to municipal law, tending to the prejudice of the community for which punishment can be inflicted as the result of judicial proceedings taken in the name of state.

The great difference between legal and the popular meaning of the word crime is, that where as the only perfectly definite meaning which a lawyer can attach to the word is that of an act or omission punishable by law, the popular or moral conception adds to this the notion of moral guilty of a specially deep and degrading kind.

 

So acts or default which tends to prejudice of the community and forbidden by law on pain of punishment inflicted at the suit of Crown. A crime is also often an injury to a private person who has a remedy in a civil action; it is an act or default contrary to the order, peace and wellbeing of the society that a crime is punishable by the state.

 

The word Crime and offence are not necessarily synonymous. All crimes are offences, but all offences are not crime.

Recently, I filed a case with the Child Protection Services of Oklahoma County against my husband. I felt he was harming my child because after he took her away from her home he also would not allow her to go to school. I have called the last four days to inform the Child Protection Services workers about any new info I could give them. I just found out this evening that they not only had informed him that I had been calling them the last four days but they also had no intention in helping me. How well does the Privacy Law work if personal info that was meant only for the State Department is being given freely to the person I filed a claim against? Legal aid is so busy that even their answering machine states that unless you are 60 years and over or if you are calling on behalf of a person 60 years of age and over you won’t be first in line
I have no money, he took my ATM card and removed $ 600, after my rent and bills paid I have only $ 30, he took my car, he took my house keys as well as his. He had me arrested on trumped up charges of schizophrenia, the doctors at the crisis center did not find me schizophrenic or even depressed. He comes in and takes things when I am not looking without knocking on the door. His family and him rallied together to take her away and wont let me even talke to her. This is all because in May, I read the Quran and changed my faith because I believed that the book was definitely sent from God.

The local authority can order a landlord to get an HMO license in which they must adhere to the terms that are set out in the licence. A landlord must inform the local authority if there are any changes in their HMO.

By law it is a landlord’s responsibility to ensure that their properties are in a decent liveable condition and that any repairs needed are fixed. A landlord should draw up a firm tenancy agreement for their tenant. A tenancy agreement should include the following;

The cost of the rent
The address of the property
When the tenancy begins and ends
The names of the tenants and landlord
The responsibilities of the tenants and landlord
How much deposit will be paid and how it will be protected

A key area of landlord law is eviction. The right legal process needs to be adhered to during the process or the landlord might risk legal action from their tenant. A landlord must first serve a ‘notice of intention to seek possession’ to the tenant. If the tenants do not leave, the next step is to go to court to decide whether a possession order will be granted. If the order is granted, the court will set a date in which the tenants must vacate the property. If the tenant still refuses to leave, a landlord will have to go to county court and apply for a warrant of eviction where the court will arrange for bailiffs to come and remove the tenants.

I am curious because I have not read much on Illinois but I do believe they do not follow the castle doctrine.

If you live in a home or apartment in Illinois and someone is breaking in, what are you legally obligated to do? What if you own a firearm? To me is someone is breaking in, they intend on committing some type of felony so I wouldn’t want to play hanky panky to find out what is goals and intentions are with breaking in.
